This Reasonable Use Policy (“Policy”) is hereby presented by Uphone.ca to its Customers as a guide to understand the intended and permissible use of service. The object of the Policy is to prevent exploitation, fraud and abuse of Services.
This policy may be subject to change from time to time and the revised copy is effective immediately upon posting to www.Uphone.ca.
Unlawful Purposes. The Customer agrees to use Uphone.ca’s services and devices solely for lawful purposes. Uphone.ca’s services cannot be used for transmitting or receiving any illegal, harmful, threatening, abusive, harassing, defamatory, obscene, sexually explicit, profane, racially or ethnically disparaging remarks or otherwise objectionable material of any kind.
This includes, but is not limited to, any material that encourages conduct that would constitute a criminal offence, give rise to a civil liability, or otherwise violate any applicable local, state, provincial, national or international law.
Uphone.ca reserves the right to terminate Service immediately and without advance notice if the Customer violates the above restrictions.
General Use. Uphone.ca may consider excessive the use of service where Customer exceeds the average or estimated client base usage patterns, reasonably determined by Uphone.ca from time to time upon its network usage analysis (“Acceptable Usage Pattern”).
Customer’s aggregated usage may be considered outside of normal if it exceeds Uphone.ca’s Acceptable Usage Pattern in conjunction with other factors that may adversely impact other Uphone.ca customers or the Uphone.ca network. Customer is prohibited from using the service or the device for auto-dialing, continuous or extensive call forwarding, telemarketing, fax or voicemail broadcasting or fax or voicemail blasting.
Voice. Unlimited Plans are subject to an aggregated voice limit not exceeding Uphone.ca’s Acceptable Usage Pattern, to a maximum of 2000 minutes of use. Usage over the 2000 minutes cap in one billing cycle, will be billed on a per minute basis at the regular Uphone.ca rates of the destinations called.
International Dialing may be enabled upon request. Customer will be required to acknowledge full responsibility for any and all traffic emanating from his device, authorized or otherwise.
Termination for Excessive use. Uphone.ca reserves the right to take immediate action, including but not limited to either suspension or termination of Service, if it determines in its sole and absolute discretion that the use of Service is at any time over the Acceptable Usage Pattern and it adversely affects the Uphone.ca network and/or other customers. Such action does not waive responsibility of any service or usage charges incurred by Customer up to and including the date of suspension or termination.
